No wrongdoing ruling expected in road flap

September 13, 2012, 8:00 pm by James Walker

District Attorney Sam Oatman has concluded that no criminal act was committed when a Burnet County work crew hauled materials to a subdivision road site and unloaded them, multiple sources with knowledge of the issue have told Highland Lakes Newspapers.

Oatman declined to reveal what conclusions he has reached after receiving a report from County Attorney Eddie Arredondo regarding an anonymous complaint alleging one of Precinct 1 Commissioner Bill Neve’s work crews illegally performed work for a private road project.

"I plan to send a report to Eddie Arredondo soon,” Oatman said.

Arredondo, likewise, said Oatman recently "indicated to me that he is going to issue an opinion on the report I sent him after my investigation” but declined to elaborate.

However, sources familiar with the issue who asked not to be identified because the letter has not been sent said Oatman concurs with Arredondo’s findings that commissioners have been operating in "good faith” based on opinions from two former county attorneys that they could legally assist with the roadwork on private roads that may also be used by public motorists.

Leslie Vance, the county’s civil attorney, told commissioners meeting Tuesday that they should refrain from working on such roads in the future unless they have been designated as county maintained roads or are part of the county’s road inventory.
