DPS: Horn had drugs in system

A Kingsland man who was involved in a fatal vehicle crash that killed a Spicewood man and two of his children could soon face charges of intoxication manslaughter.

Paul Wesley Horn had drugs in his system at the time of the crash, according to a report from the Department of Public Safety.

Horn is in the Llano County Jail on warrants unrelated to the crash.

“He tested positive for a drug other than alcohol,” said Tela Mange, a DPS spokeswoman. “We are going to ask the district attorney to present three counts of intoxication manslaughter to the grand jury.”

Mange said state troopers are wrapping up their investigation and will have a final crash report ready in time for the August meeting of the grand jury.

DPS protocol forbids releasing the type of drug found in a defendant’s system for medical privacy reasons until the final crash report is released.

The DPS reports a 2007 Dodge pickup driven by Horn crossed a center stripe on SH 71, just west of Spicewood around 9:18 a.m. Saturday, June 6 and collided with a 2005 Nissan Altima.

Russell Rutland, 37, who was driving the Altima, his daughter Maddison, 4, and his son Hunter, 8, all of Spicewood, were pronounced dead at the scene by Precinct Four Burnet County Justice of the Peace Edward Cutchin.

Two other Rutland children, Kole, 5 and Zachary, 9, were taken to Dell Children’s Medical Center in Austin, where they were examined and released.

Horn was taken to the Burnet County Jail after being examined at Seton Highland Lakes on bonds totaling $33,500.

He was jailed on charges of failure to appear on a traffic warrant, obstruction or retaliation, and driving with an invalid license, investigators said, and was later transferred to the Llano County Jail.

A benefit fund has been established for the surviving children called the Russell Kyle Rutland Children’s Trust Fund at Security State Bank in Marble Falls.
